独占禁止法とは

その正式名称は「私的独占の禁止及び公正取引の確保に関する法律」である。その目指すところは、公平で自由な競争の奨励と、事業者が独自の選択で活動しやすい環境の確立である。もし市場のしくみが正常に機能しているならば、事業者は自らの創造性を活かし、よりコストパフォーマンスの高い商品を提供して売上を増やすでしょう。そして消費者は、自分のニーズに適した商品を選び取ることが可能となり、競争によって消費者の利益が確認されることとなる。この考えを基にした競争の維持と奨励の方針を「競争政策」と呼んでいる。
