瑕疵担保責任とは

「瑕疵担保責任」とは、商品や物件に見えない欠陥（瑕疵）が存在した際、それを隠していた売主が買主にその責任を負うことを指す言葉です。この状況に陥った買主は、契約を解除したり、損害賠償の請求を行うことが認められます。但し、これらの請求が可能となる条件として、販売時にその欠陥を知らなかった、かつその知らなかった事実に買主の責任が無い場合とされています。こうした瑕疵の例としては、建物の構造に問題があったり、屋根から雨が漏るといった状況が挙げられます。なお、この瑕疵担保責任については、買主が瑕疵を知った時点から1年以内に請求を行わなければならないと民法により定められています。ただし、これには特例等は指定されていません。
