企業が企業組織の再編成を目指し、共同事業を展開する目的がある場合、一定のクリテリアの適合が確認されることで、その再編成は税制面で適格と認識されます。これは企業グループ内での企業組織再編成と同じ要領です。ただし、共同事業と認定されるためには、5つの要件全てを満たす必要があります。それらは、事業関連性要件、事業比率要件または経営参画要件、独立事業単位要件、事業継続要件、そして株式継続保有要件となります。’
