「仲裁」とは、対立する当事者が双方ともに第三者に紛争の解決を託す制度であり、その第三者の決断が当事者に対して拘束力を持つことにより、問題の解消を図るものです。この仲裁は、当事者間の合意によって達成される調停や、一方の申し立てをもとに国内あるいは国際的な裁判所が強制的に解決を図る訴訟とはその性質が異なるものとなっています。
