寄託とは

寄託’は、一方の当事者（受寄者）が、他方の当事者（寄託者）のために物品を保管する契約を結び、その物品を受け取ることでその契約が成立するという概念を指します。これは民法第657条にも明記されており、「寄託」は一方の当事者が他方のために保管することを約し、特定の物品を受け取ることでその契約が有効となる、とされています。

物流の文脈では、業務用倉庫での商品保管がこの寄託契約の例となるでしょう。また、我々の日常生活においては、銀行への預金の預け入れ契約も寄託契約の一例であり、これは「消費寄託」という形式に該当します。
